Pilotryx Terms of Use

These Terms of Use govern access to and use of the Pilotryx website, the PilotCheck mobile application, Pilotryx testing programs, and related services.

Pilotryx is a trade name operated by an individual software developer. In these Terms, “Pilotryx,” “we,” “us,” and “our” refer to that individual operator.

“PilotCheck” means the general-aviation pilot companion application published under the Pilotryx brand.

1. Acceptance of these Terms

By accessing the Pilotryx website, joining a Pilotryx testing program, creating a PilotCheck account, or using PilotCheck, you agree to these Terms and acknowledge the Pilotryx Privacy Policy.

Do not use the services if you do not agree to these Terms.

Where you use PilotCheck on behalf of a flying club, flight school, aircraft operator, organization, or another person, you represent that you have authority to do so.

2. Eligibility

You must be legally capable of accepting these Terms.

PilotCheck is not directed to children under 13. A person who cannot legally consent to online services independently may use PilotCheck only with the appropriate authorization and supervision of a parent or legal guardian.

PilotCheck does not determine whether a user is licensed, qualified, current, medically fit, or otherwise authorized to operate an aircraft.

3. Description of the services

PilotCheck is a general-aviation utility and electronic-flight-bag companion that may include:

• User-configurable aircraft checklists;
• Flight Risk Assessment Tool, or FRAT, scoring;
• Saved or commonly used radio-frequency information;
• Pressure and unit-conversion tools;
• Timers and other cockpit-reference utilities;
• Aircraft profiles and related user-entered information; and
• Beta or experimental features made available for testing.

Features may differ between platforms, application versions, beta groups, and users. Some features may be incomplete, experimental, modified, unavailable, or removed without notice.

Unless expressly stated otherwise, PilotCheck does not provide certified navigation, aircraft tracking, automated flight recording, maintenance tracking, regulatory-compliance monitoring, dispatch services, air-traffic services, or authorization to conduct a flight.

4. Aviation safety limitations

PilotCheck is a supplemental reference tool only. It is not an approved or authoritative source of aeronautical or operational information.

PilotCheck does not replace and must not be used instead of:

• The applicable Pilot’s Operating Handbook or Aircraft Flight Manual, including supplements and revisions;
• Manufacturer-approved or operator-approved checklists and procedures;
• Current aeronautical charts, publications, NOTAMs, weather information, or official weather briefings;
• Applicable aviation laws, regulations, operating limitations, airworthiness requirements, directives, or instructions;
• Flight planning, aircraft-performance calculations, weight-and-balance calculations, fuel planning, maintenance information, or dispatch procedures;
• Air-traffic-control instructions or current published frequencies;
• Proper training, instruction, supervision, licensing, ratings, medical fitness, recency, proficiency, or endorsements; or
• The independent judgment and legal responsibility of the pilot in command.

PilotCheck is not certified or approved by the FAA, EASA, the Civil Aviation Authority of Israel, or any other aviation authority unless a particular feature expressly states otherwise.

You remain solely responsible for the safe and lawful planning, commencement, continuation, diversion, and completion of every flight.

5. Checklists and aircraft information

PilotCheck may allow you to create, import, modify, organize, and use aircraft profiles and checklists.

You are responsible for verifying every checklist, checklist item, sequence, limitation, note, aircraft detail, and procedure against the current approved documentation for the specific aircraft being operated.

A checklist supplied with PilotCheck, imported from a file, created for another aircraft, or based on a template may contain errors, omissions, outdated information, or information that does not apply to your aircraft.

You must not rely on PilotCheck to determine aircraft airworthiness or compliance with maintenance requirements.

6. FRAT limitations

PilotCheck’s Flight Risk Assessment Tool provides advisory decision support based on information selected by the user and the scoring method implemented in the application.

A FRAT result:

• Is not an authorization to fly;
• Is not a declaration or guarantee that a flight is safe;
• Cannot identify every possible hazard;
• May be affected by incomplete, inaccurate, subjective, or outdated inputs; and
• Does not replace operator policies, instructor review, dispatch review, regulatory requirements, or pilot-in-command judgment.

A low or moderate score does not mean that a flight should proceed. The pilot must independently identify, assess, mitigate, and continuously reassess risk.

7. Frequencies, conversions, timers, and reference information

Radio frequencies, airport information, conversion results, timer values, and other reference information may be inaccurate, incomplete, outdated, entered incorrectly, or unsuitable for a particular operation.

You must verify frequencies and operational information using current authoritative sources and comply with air-traffic-control instructions.

You are responsible for verifying units, input values, decimal placement, conversion results, and altimeter settings before operational use.

Do not use PilotCheck as the sole means of timing, navigation, communication, terrain avoidance, traffic avoidance, or emergency decision-making.

8. Beta testing

PilotCheck may be provided as beta, early-access, pre-release, or testing software.

Beta software may contain defects, lose locally stored data, produce unexpected results, consume additional device resources, or stop functioning. Features and data formats may change without backward compatibility.

You should not use beta software in any situation where an error, interruption, or loss of data could create an unacceptable safety risk.

Participation in a testing program does not guarantee selection, access, continued access, publication of the application, compensation, or inclusion of requested features.

9. Accounts and security

Some PilotCheck features may require an account.

You agree to provide accurate account information, protect your password and devices, and promptly notify us of suspected unauthorized access.

You are responsible for activity conducted through your account unless it results from conduct for which Pilotryx is legally responsible.

We may require email verification, password resets, or other reasonable security measures. We may suspend access where reasonably necessary to investigate misuse, protect users, protect the services, or comply with legal obligations.

10. User-created and locally stored data

You retain ownership of aircraft profiles, checklists, checklist items, notes, files, feedback, and other material you create or provide.

The current PilotCheck beta stores aircraft and checklist information locally on the user’s device unless a feature expressly states that information will be uploaded or synchronized.

You grant Pilotryx only the limited rights reasonably necessary to process information that you intentionally submit to Pilotryx servers, forms, support channels, testing systems, or feedback systems.

You are responsible for maintaining appropriate backups. Local data may be lost when PilotCheck is removed, application data is cleared, a device is reset, a file is overwritten, or a device is lost or damaged.

Pilotryx is not obligated to recover locally stored data.

11. Imported files and third-party content

You may only import, submit, or use content that you have the right to use.

Pilotryx does not verify the accuracy, legality, completeness, or suitability of imported checklist files or third-party content.

References to aircraft manufacturers, aviation authorities, airports, publications, or third-party products do not imply affiliation, endorsement, approval, or certification.

12. Feedback

When you submit product feedback, testing reports, suggestions, or feature ideas, you permit Pilotryx to use them without restriction or compensation to develop, improve, market, and operate Pilotryx products.

This permission does not transfer ownership of your aircraft records, checklists, or other personal operational content.

13. Acceptable use

You may not:

• Use the services unlawfully or encourage unsafe or illegal aviation activity;
• Misrepresent PilotCheck output as official, certified, or regulator-approved information;
• Attempt to gain unauthorized access to accounts, systems, databases, or source code;
• Introduce malicious code or interfere with the operation or security of the services;
• Scrape, overload, reverse engineer, reproduce, resell, or commercially exploit the services except where applicable law expressly permits;
• Impersonate another person or misrepresent an affiliation with Pilotryx; or
• Use the services in a way that infringes another person’s rights.

14. Intellectual property

PilotCheck, the Pilotryx website, Pilotryx branding, software, interface, graphics, documentation, and original content are owned by the Pilotryx operator or applicable licensors and are protected by intellectual-property laws.

Subject to these Terms, Pilotryx grants you a limited, personal, revocable, non-exclusive, and non-transferable licence to use PilotCheck for its intended purposes.

No ownership rights are transferred to you.

15. Third-party services and app stores

The services may depend on third-party providers, including hosting, authentication, database, security, email-delivery, operating-system, and app-store providers.

Your use of an app store or third-party service may also be governed by that provider’s terms.

Pilotryx is not responsible for a third party’s independent services, availability, policies, or conduct.

16. Availability and changes

We do not guarantee that PilotCheck or the Pilotryx website will always be available, error-free, complete, compatible with every device, or maintained indefinitely.

We may modify, suspend, restrict, or discontinue any part of the services. Where reasonably practical, we will provide notice of material changes that significantly affect registered users.

17. Disclaimer of warranties

To the maximum extent permitted by law, the services are provided on an “as is” and “as available” basis.

Pilotryx disclaims warranties of accuracy, completeness, availability, reliability, merchantability, fitness for a particular purpose, non-infringement, and suitability for operational or aviation use.

Pilotryx does not warrant that the services will identify every risk, prevent an accident or incident, satisfy any regulatory requirement, or produce an appropriate operational decision.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

18. Limitation of liability

To the maximum extent permitted by law, the Pilotryx operator and any contractors or service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of data, revenue, opportunity, goodwill, or anticipated savings arising from the services.

Pilotryx is not responsible for decisions to begin, continue, divert, or cancel a flight; reliance on a checklist or FRAT result; incorrect frequencies or conversions; failure to consult authoritative information; or loss of locally stored data.

Where liability cannot be excluded, Pilotryx’s aggregate liability arising from the services will be limited to the greater of:

1. The amount you paid directly for the relevant Pilotryx service during the twelve months before the event giving rise to the claim; or
2. USD 100 or its local-currency equivalent.

This limitation does not apply to fraud, wilful misconduct, gross negligence where it cannot legally be limited, or another liability that applicable law does not permit us to exclude or limit.

19. Indemnity

To the extent permitted by law, you agree to indemnify the Pilotryx operator against third-party claims resulting from your unlawful use of the services, infringement of another person’s rights, or deliberate misuse of PilotCheck.

This provision does not require a consumer to indemnify Pilotryx for Pilotryx’s own negligence, breach, or unlawful conduct.

20. Suspension, termination, and deletion

You may stop using the services at any time and may request deletion of your account as explained in the Privacy Policy.

We may suspend or terminate access where reasonably necessary because of a material breach of these Terms, a security risk, unlawful activity, technical necessity, discontinuation of the service, or a legal obligation.

Sections that by their nature should survive termination—including aviation responsibilities, intellectual property, disclaimers, and liability limitations—will continue to apply.

21. Changes to these Terms

We may update these Terms to reflect changes to the services, legal requirements, safety requirements, or business practices.

Updated Terms will be posted with a revised effective date. Where required by law, we will provide additional notice or request renewed acceptance.

22. Governing law and disputes

These Terms are subject to applicable law and to any mandatory consumer rights that cannot be waived by contract.

Pilotryx does not designate an exclusive governing jurisdiction or court through these Terms unless that designation is added in a future revision.

Nothing in these Terms limits a right or remedy that cannot legally be limited.
